Fix the Ball Ltd – Standard Competition Operating Terms
Qualifying Persons
Fix the Ball Ltd. (‘Promoter’, ‘our(s)’) operate competitions – skill based games resulting in the allocation of Cash only as prizes in accordance with these terms and conditions on the website www.fixtheball.scot (the ‘Website’) – (the ‘Competition(s)’).
The Competitions are open to all persons aged 18 and over except the Promoter’s employees (permanent or on a temporary ad hoc basis) or members of their immediate family, agents or any other person or persons immediate family who is connected with the advertising (Partners employees), creation or administration or judging of our Competitions.
Legal Undertaking
By entering a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’) will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material on our web site.
Competitions are governed by UK law and any matters relating to the Competition will be resolved under UK Law and the Courts of UK shall have exclusive jurisdiction.
In the event that you participate in a Competition online via the Website, and by accepting these terms and conditions you confirm that you are not breaching any laws of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any entrant entering any of our Competitions unlawfully. If you are entering from abroad and are in any doubt you should not take part in the competition and check with the relevant authorities in your country.
Competition Entry Requirements
Competitions may be entered online via the Website.
Availability and pricing of Competitions is at the discretion of the Promoter and will be specified at the point of sale on the Website.
Your FixtheBall.scot Account(s)
In order to enter a Competition, you will need to register an account online with us. We need this to store your contact and ticket entry information so that your ticket entry coordinates are considered during the judging process.
To register an account online you will be asked to provide an email address and password in order to log in to your account and enter the competition.
Please note that your email address will also be the username that you use to log in to your account. Each account can only have one username attributed to it at any given time.
When playing a Competition online via the Website, follow the on-screen instructions to:
Select your tickets by clicking on the amount of tickets you want to play from the tickets table for the cash prize.
Enter the competition by playing tickets in the Fix-the-Ball game and when you are ready to checkout (purchase your ticket(s)), provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions.
For each Ticket that you have purchased, you will need to complete a Fix-the-Ball entry on screen, which shall operate as follows:
You will be shown a sporting photograph from which the ball has been digitally removed;
You will be shown a spUsing all the information shown in the sporting photograph displayed on the computer screen use your skill and judgment to correctly identify the grid coordinate within which you consider is the most likely position for the centre of the ball before it was digitally removed from the image;orting photograph from which the ball has been digitally removed;
Drag the crosshair curser to the required position and click the FIRE X button (on mobile devices only. Click your mouse to place a cross (X) directly onto the image on a laptop or desktop) to mark this spot with a cross (you will see your cross’s coordinates on the screen). The computer will register this X,Y coordinate as your entry into the Competition
(‘Fix-the-Ball Challenge’);
You may repeat the process for the Fix-the-Ball Challenge for as many entries as you wish to make, up to the specified limit of 20 entries per competition. You will require one Ticket for each X entry.
When your payment has cleared we will then contact you by email to confirm your entry into the Competition. Please note that when entering online you will not be deemed entered into the Competition until we confirm your Ticket(s) order back to you by email.
(‘Website Entries’ referred to as ‘Entr(y)(ies)’)
The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of these terms and conditions.
To the extent permitted by applicable law, all Entries become our property and will not be returned.
Entries (tickets) are limited to twenty (20) per person per competition. Abuse of this limit will not be tolerated and if the Promoter has reasonable grounds to believe that an individual is exceeding this limit by entering using multiple accounts, it reserves the right at its sole discretion to void any orders, any Game Credit earned or to award any winning runner up (in the event that there is a tie) or runner up prize for the next closest entrants.
Entries (tickets) are limited to twenty (20) per person per competition. Promotion Periods
Each Competition will run for a specified period of usually 1 or 2 weeks as instructed by the promoter. Each competition will end at 11:00 hrs every Monday morning or every second Monday morning if running for 2 weeks and the next will begin at approximately 11:30 hrs on the same morning.
Competition Judgment
The XY coordinate position of the centre of the ball in the original image is determined during the judging process and entries that match or are closest to this XY coordinate will be deemed the winner. (the image used in the competition is a copy of the original with the ball digitally deleted). The original image which still has the ball featured is used in the judging process – both the copy and the original are of exact same size and resolution. The independent auditor will officially review the video of the judging process but will not participate as a judge himself. He will however act with full autonomy and is free to scrutinise and request that the judging process be repeated if it is not carried out to his full satisfaction. He will be appointed by Fix the Ball Ltd. acting lawyers firm Licensinglaywers.scot, (Registered trading name of Licensing and Safety Lawyers Ltd) Prama House, 267 Banbury Road, Oxford, OX2 7HT
The promoter, will use specially developed software designed to assist in the determination of the centre of the actual ball position in the original image. The software will enable the use of 4 different cursors placed such that the cursor can be manually aligned as close as visually possible with the centre of the ball in the original image. The four cursors will be placed in turn by the Promoter. The coordinates of each cursor in turn are recorded but not made visible until all four cursor coordinates are saved. When all the coordinates are revealed the promoter will decide that the 4 cursor coordinates are of close enough grouping such that they can be used in the final winning coordinate calculation which is an average XY coordinate of all four cursor XY coordinates. The software then calculates the average position of all 4 cursor centre coordinates. The result of this averaging calculation (the average X coordinate is rounded up to the nearest whole coordinate and the average Y coordinate is rounded down to the nearest whole coordinate) is deemed the centre of the ball X,Y coordinates.
The Promoter will then click the ‘Find the Winning Coordinates’ button on the judging page. The software will automatically query the competition entry database where all entries for that specific competition are saved. The software will automatically reveal the winning coordinates and, when prompted by clicking the ‘Find the Winner’ button will reveal the winners name and city the winner is from (winner of the First Prize) and determine all winning runners up (tied for first place but knocked out on software winner logic) runners up (10 runners up chosen at random who’s crosses are next closest crosses to center of ball coordinates) and credit awards.
The entire judging process will be recorded on screen via screencast video recording software. Only the winners name and city he/she is from, will be shown in the recording.
After the judging video has been reviewed and found to be acceptable by the independent auditor the recording of the judging process will be made available to all players who entered the competition via email link. This is how the winner will find out he or she has won. The promoter or representative of the promoter will not contact the winner to confirm he/she has won until 8 pm the day after judging ie on the Tuesday afternoon/evening.
It is the Entrant’s sole responsibility to check and update their contact details. If for any reason they are taken down incorrectly, the Promoter will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.
Within Three (3) days of the end of the respective Competition, all competition results will be uploaded to the competition results page of the website for all participants to view.
The First Prize Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the center of the ball coordinates as determined by the method described above. The Software will select Ten (10) runners up Entries, who will be adjudged to be the ten (10) Entries (after the Winner) closest to the winning position. If there are more than 10 within the same distance, then a random 10 will be selected.
For the avoidance of doubt, distance will be measured by calculating the straight line distance from each valid and eligible Entry to the winning coordinate Position (‘Distance’) using Pythagoras theorem, as follows;
Winning coordinates = Xw, Yw
Your entry coordinates = Xe, Ye
Distance = √(Xw-Xe)² + (Yw-Ye)²
Distance = √(X)² + (Y)²
n the event that there are two or more Entrants with valid and eligible Entries that are equally close to or exactly match the winning coordinates (each a ‘Play-Off Entry’), the entrants to whom such Play-Off Entries belong, identified by their Fix the Ball Ltd. Account (the ‘Play-Off Entrants’) will participate in a knock-out procedure programmed within the judging software to determine the First Prize Winner for such Competition as follows:

Play-Off Scenario 1
In the event that each of the Play-Off Entrants has made multiple Entries to the Competition:
In Play-Off Scenario 1, the other Entries to the Competition made by each Play Off Entrant using the same Fix the Ball Account as their respective Play-Off Entry will be used to determine the First Prize Winner as follows – the First Prize Winner will be determined by calculating the Distance of the next closest Entry to the center of ball coordinates (excluding the Play Off Entry) (‘PO1 Entries’) made by each Play-Off Entrant in that Competition (‘Play-Off 1’). In the event that Play- Off 1 results in a Play-Off, the Play-Off 1 process will be repeated with 3rd, 4th and 5th entries, if they exist, or until there are no more PO1 Entries to judge.
Play-Off Scenario 2
It is Fix the Ball Ltd policy to prioritise those that enter the highest number of ticket entries.
Therefore, if, for example, 5 players have tied for First Prize (extremely unlikely). If 1 or more of those players only have one ticket they will be excluded and offered a Winners Runner up award of £50 game credits. This leaves 4 players (assuming only 1 player had one ticket) to have their next closest tickets measured.
Assume 3 of the 4 still tie with their next closest tickets. The other who has not tied will also be excluded from the play-off and also be awarded £50 in game credit as a Winners runner up. The remaining 3 will go to the next play off and have their 3rd closest crosses measured. However, if one or more of these does not have another ticket to measure he will be excluded and also be issued £50 winners runner up game credit.
This process will continue until there is a single outright winner.
Play-Off Scenario 3
If, however, the final 2 or 3 players have still tied and neither has another ticket, (Or if in the event that all of the Play-Off Entrants has only made one (1) Entry to the Competition) they will be asked to play in a playoff game where each will get one chance to identify the winning coordinates of a new Fix-the-Ball competition image. The closest to the winning coordinates of that image will be confirmed as the outright winner.
The Runners Up will be chosen using the same process as set out for the First Prize Winner above. Runners up are not Winners Runners up since they did not tie for first prize. Runners up are the next closest to the center of the ball coordinates excluding all Winners runners up. The runners up will be awarded £10 game credit.
If for any reason the Promoter is unable to contact the outright first prize competition Winner within 3 days (which may be extended at the sole discretion of the Promoter) of the end of a Competition or the Winner fails to confirm acceptance of the prize or the Winner is disqualified as a result of contravening any of these terms and conditions, the Winner will forfeit the prize and it will be awarded to the Entrant with the next closest coordinates or in the case of a play off to the entrant last removed due to the knock out process, as defined in the judging process. For the avoidance of doubt once the prize has been forfeited, the original Winner, Winning Runners Up or Runners Up will have no further claims against the Promoter.
The First Prize Winner, the Winning Runners Up (Play off entrants) and the Runners up are all referred to as ‘Winner(s)’.
In the event that the Promoter has to close a Competition early for reasons beyond its control, the Winner will be selected from all valid and eligible Entries received by the Promoter up to the time of closure. The Promoter also reserves the right at its sole discretion to extend the closing date of any Competition.
Competitions will never be initiated without sufficient funds being available to award the first prize regardless of the number of tickets sold.
However, the promoter will retain the right to cancel any competition. Should the promoter exercise the right to cancel the competition all players who participated in that competition will be refunded, in full, within 3 days of competition closure.
All Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to any future Promotions or Competitions offered by the Promoter.
Winner’s Details
The First Prize Winner will be required to send a copy of their passport or other formal photographic ID (driving licence) to the Promoter to confirm their identity, age and also to prove that the credit/debit card used to make the purchase was legally theirs or that they had authorisation to use it, and proof of their residence, before any prize will be paid or delivered. Any failure to meet these obligations may result in the First Prize Winner being disqualified and the Promoter choosing an alternate winner.
All Winners will also be required to provide selfie photographs which include themselves and others if they wish and also the large partner branded cheque sent to the winner and printed out in colour by the winner for the photograph and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.
Following receipt and verification of the details requested above by the Promoter, the Winners will be contacted in order to make arrangements for delivery of the cash prize. At this point the Winners must provide bank details into which the cash prize amount can be deposited by online transfer.
Competition Prizes
Cash Prizes will be transferred as soon as possible in GBP sterling and will be converted by the receivers bank into your local currency at the current exchange rate at the time of transfer.
Runners Up Prizes: Ten (10) Runners Up Prizes will be awarded for each Competition only, in the following manner. The ten (10) Runners Up will each receive £20 worth (face value) of Competition game credit for Competitions run by the Promoter.
Play-Off Entrants: Anyone involved in a Competition Play-Off, except the First Prize Winner will automatically receive £50 of game credit to play future Competitions.
Game credit cannot be exchanged for cash.
All other expenses not expressly specified herein are the sole responsibility of the Winners.
Winners’ Personal Data
Acceptance of the prize by the Winner will mean they are required to supply selfies or have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use unless prohibited by law.
By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, without any additional compensation and as required by the Promoter if you are declared a Winner.
Electronic Communications
No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability. The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket coordinates recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event. Competition coordinates may be checked at any time by accessing your account at fixtheball.scot
Data Protection Notice
Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
